{"id":7317,"date":"2025-01-06T22:01:07","date_gmt":"2025-01-06T22:01:07","guid":{"rendered":"https:\/\/investingsstrategist.com\/index.php\/2025\/01\/06\/trump-asks-court-to-delay-fridays-sentencing-for-his-hush-money-conviction\/"},"modified":"2025-01-06T22:01:07","modified_gmt":"2025-01-06T22:01:07","slug":"trump-asks-court-to-delay-fridays-sentencing-for-his-hush-money-conviction","status":"publish","type":"post","link":"https:\/\/investingsstrategist.com\/index.php\/2025\/01\/06\/trump-asks-court-to-delay-fridays-sentencing-for-his-hush-money-conviction\/","title":{"rendered":"Trump asks court to delay Friday\u2019s sentencing for his hush money conviction"},"content":{"rendered":"<p class=\"paragraph inline-placeholder vossi-paragraph\">            Donald Trump is asking the judge in his New York hush money case to scrap his Friday sentencing date while the president-elect appeals his conviction.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\">            But the Manhattan district attorney\u2019s office is urging Judge Juan Merchan to stick by his plan.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\">            Trump\u2019s lawyers filed an appeal on Monday urging a New York appellate court to overturn the judge\u2019s two recent rulings that upheld his conviction in the hush money case, while separately urging Merchan in a filing Monday to postpone Trump\u2019s sentencing while he appeals.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\">            Trump\u2019s legal maneuvers come on the same day that he was certified as the winner of the 2024 presidential election \u2013 and four years since he tried to overturn his election loss and his supporters rioted at the US Capitol.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\">            On Friday, Merchan rejected Trump\u2019s attempt to throw out his conviction because he\u2019s been elected president, scheduling Trump\u2019s sentencing in the hush money case for Friday \u2013 though Merchan made clear he would not sentence him to any jail time.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\">            Trump\u2019s lawyers argued that the sentencing must be put on hold while his appeals play out. They asked the judge for a Monday response to their request.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\">            \u201cThe Court should vacate the sentencing hearing scheduled for January 10, 2025, and suspend all further deadlines in the case until President Trump\u2019s immunity appeals are fully and finally resolved, which should result in a dismissal of this case, which should have never been brought in the first place,\u201d Trump\u2019s filing states.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\">            The Manhattan district attorney\u2019s office urged Merchan to deny Trump\u2019s request to postpone his sentencing, according to a filing sent to the judge.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\">            \u201cDefendant will suffer no prejudice from the conclusion of criminal proceedings in the trial court given the Court\u2019s intended sentence of an unconditional discharge and defendant\u2019s decision to appear for sentencing virtually instead of in person\u2014indeed, entry of judgment is necessary to allow the appeal defendant has repeatedly stated he will pursue,\u201d prosecutors wrote in the filing.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\">            \u201cAnd the current schedule is entirely a function of defendant\u2019s repeated requests to adjourn a sentencing date that was originally set for July 11, 2024; he should not now be heard to complain of harm from delays he caused,\u201d prosecutors added.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\">            On Monday afternoon, Trump\u2019s attorneys filed an appeal with a New York appellate court seeking to overturn Merchan\u2019s rulings that upheld Trump\u2019s conviction. Trump\u2019s lawyers did not ask the appeals court to intervene in the sentencing \u2013 though they could take that step if Merchan moves forward with his plans to sentence Trump Friday.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\">            \u201cJustice Merchan\u2019s erroneous decisions threaten the institution of the Presidency and run squarely against established precedent disallowing any criminal process against a President-Elect, as well as prohibiting the use of evidence of a President\u2019s official acts against him in a criminal proceeding,\u201d Trump\u2019s attorneys wrote in the filing with the appeals court Monday.    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\">            Trump was convicted in May on 34 counts of falsifying business records over payments to his then-lawyer Michael Cohen to reimburse a $130,000 hush money payment made to adult-film star Stormy Daniels, in order to keep her from speaking out about an alleged affair before the 2016 election. (Trump has denied the affair.)    <\/p>\n<p class=\"paragraph inline-placeholder vossi-paragraph\">            Trump was initially set to be sentenced in the case in July, but that was delayed until after the election in light of the Supreme Court\u2019s ruling on presidential immunity.
